TERMS OF SERVICE

1. Shopping 


1.1 The object of the provision of services is a sale and purchase agreement  by Modern HST MP Prytulak sp.j, hereinafter referred to as Modern HST or the Seller.

1.2 Commercial information on this website does not constitute an offer within the meaning of the Civil Code  but are an invitation to place an order.
1.3 Customer bears the cost of shipping order.

1.4 All information about protection of personal data are contained in the Privacy Policy (Click)

1.5 Basic conditions of completing the order are: correct filling up the order form on site modernhome.pl, choosing the payment method and sending the order.  Confirmation of the order is made via email by shop personnel.
1.6 Online Shop takes orders 24/7, whole year. Orders placed on Sundays and holidays will be processed on the first working day following the day on which the order has been placed.
1.7 Modern HST reserves the right to reject incorrectly or partially filled order forms.
 

1.8 All prices are in PLN (can be switched to EUR) and they contain VAT tax.
Product price does not include shipping cost. The shipping cost is calculated separately in accordance with the table of fees displayed each time in order summary. ModernHST reserves the right to change prices without informing the customers, however, prices are fixed for the orders that currently are being processed.

1.9 ModernHST draws sale documents, which can be either invoices or receipts.

1.10 Order will be processed if the product is available in the store. If the shop is out of stock, customer will be informed, and presented with the choice of: partial completion, waiting for the shop to acquire the missing product, or cancelling the order.


2. Delivery conditions

2.1 Customer can choose following delivery methods:
a. Personal collection in modernHST shop, Ostrołęka, 11 listopada 5a, POLAND
b. Delivery by Polish Post Office
c. Delivery by courier (UPS, DPD or other)

2.2 ModernHST obliges to start processing the order within 4 working days from receiving it.

2.3 Processing of the order depends on:
- checking if the informations supplied by Customer  are true and complete,
- contacting the Customer by phone or email to confirm the order. If the customer confirms all informations, his/her order will be confrimed for processing. After that, order can't be modified.

2.4 Final confirming means that the ordered product will be sent to the customer. If the payment method is credit card or a bank transfer - proper amount of cash will be taken from the account.

2.5 Indispensable condition of claiming the article in person is showing Identity Card and the knowledge of the correct order number.

Estimated time of delivery and the cost is visible in each case at the time of placing the order through the website store. The costs of delivery are subject to change with the change of pricing operators, as well as depending on the weight and / or size of the shipment.

2.7 Ownership of the goods delivered to the buyer only upon the complete payment covering the remuneration payable to the Vendors (main claim), interest and other costs arising from the contract.
2.8  Modern HST reserves the right to refuse shipment of goods by specific carrier (such as large-size goods via Polish Post), if there isn`t  technical capacity of the service, or if the carrier does not guarantee sufficient protection for transported goods.



3. Complaints and warranties

3.1 If the customer finds any technical defects, he can use the producer's warranty or the advised services (relates to products with producer's warranty).

Period and conditions of the guarantee are indicated in the warranty card and / or the description of the goods in the store. 

3.2 In the case of non-conformity, touted goods should be returned by courier service, the Polish Post Office or any other logistics company, to address modern HST store or delivered to the company. The Purchaser shall inform the Seller's what the non-compliance and its expectation of how the complaint.
 
3.3
Within 14 days from the date of receipt by the Seller, the Purchaser complaint concerning the lack of conformity, the seller should resolve the complaint and give a concrete answer to the Employer on account of or rejection of his complaint. In the event that a claim by the Seller will be the Purchaser by the Seller indicated the proposed method and the procedures for its implementation (eg, the manner for refunding the buyer of the goods, how to repair the goods or exchange for other goods, the method of receipt of goods, etc.) - in which case the Seller shall also transport costs advertised goods. In the event of refusal to recognize a claim to the buyer is the reason for the refusal.


4. Right to withdraw for distance agreement 

4.1 
You have right to withdraw for distance agreement within 14 days without cause. You should inform us about this within 14 days.
This action can't be made by the companies that bought the items, only private clients can apply.

4.2 In case of returning the product, customer should send it back within 14 days from claiming it. Costs of delivery are covered by customer.

4.3
The Purchaser in connection with the withdrawal from the contract is obliged to return the product in the same state, unless a change was necessary in the ordinary management.   Products must be returned within 14 (fourteen) days from the date of declaration of withdrawal for distance agreement.
4.4 If all conditions of returning the article are fulfilled, repayment will be made immediately.


5. FINAL CLAUSES


5.1 In matters not regulated by these rules shall be governed by the applicable law, including the provision of the Civil Code.

5.2 The contract of sale of goods is concluded in accordance with the law of Polish and in Polish to Polish customers, in English for foreign customers.

5.3 Customers can get access to these Rules at any time through the link found on the main site www.modernhome.pl and download it and print.


Consolidation, security, access and the confirmation of the relevant provisions of the Agreement follows the sale of Goods by  sending them to customers e-mail address. Earlier orders Customer may see in his account, after logging if registered in store and has given his consent.
