| Terms of service Terms of serviceTERMS OF SERVICE
1. Shopping 1.1 Basic conditions of completing the order are: correct filling up the order form on site modernhome.pl, choosing the payment method and sending the order. 1.2 Confirmation of the order is made via email by shop personnel. 1.3 Customer can change the order until the last confirmation by phone or email. 1.4 By sending the order, customer declares that he knows shop's Terms of Service, and is aware of possibility of cancelling the agreement, according to the law from 2 march 2000 ""O ochronie niektórych praw konsumentów oraz o odpowiedzialności za szkodę wyrządzoną przez produkt niebezpieczny", (Dz.U. 2000 Nr 22, poz. 271)" and accepts its decisions. 1.5 Internet shop modernHST accepts orders whole year, 24/7. Orders that are sent on Sundays or holidays will be processed on the first working day after the date of sending the order. 1.6 modernHST reserves the right to reject incorrect or half filled order forms. 1.7 All prices are in PLN (can be switched to EUR) and they contain VAT tax. modernHST reserves the right to change prices without informing the customers, however, prices are fixed for the orders that currently are being processed. 1.8 modernHST draws sale documents, which can be either invoices or receipts. 1.9 Order will be processed if the product is available in the store. If the shop is out of stock, customer will be informed, and presented with the choice of: partial completion, waiting for the shop to acquire the missing product, or cancelling the order. 2. Delivery conditions 2.1 Customer can choose following delivery methods: a. Personal collection in modernHST shop b. Delivery by postal order or courier 2.2 modernHST obliges to start processing the order within 24 hours from receiving it. 2.3 Processing of the order depends on: - checking if the informations supplied by Customer are true and complete, - contacting the Customer by phone or email to confirm the order. If the customer confirms all informations, his/her order will be confrimed for processing. After that, order can't be modified. 2.4 Final confirming means that the ordered product will be sent to the customer. If the payment method is credit card or a bank transfer - proper amount of cash will be taken from the account. 2.5 Indispensable condition of claiming the article in person is showing Identity Card and the knowledge of the correct order number. 3. Complaints and warranties 3.1 If the customer finds any technical defects, he can use the producer's warranty or the advised services (relates to products with producer's warranty) 3.2 If the mechanical defects arise during delivery, the customer should send defective product back to us. Shop does not accept parcels paid on delivery. 3.3 The purchase documents should be attached to the product. 3.4 Complaints are being processed in 14 days from receiving the package with defective product. 3.5 In case of justifiable complaints, the defective product will be fixed or replaced with a new one. If it's not possible (for example lack of the product in stock), shop will refund the customer's order in cash. Complaints should contain description of the defect and date of defect. 3.6 Shipping cost of the returned defective product will be returned to the customer by shop, after accepting complaint as valid. 4. Return of the products 4.1 According to the law from 2 march 2000 "O ochronie niektórych praw konsumentów oraz o odpowiedzialności za szkodę wyrządzoną przez produkt niebezpieczny", (Dz.U. 2000 Nr 22, poz. 271), the customer can return the product bought in our shop without giving any reason. It can be done only within 10 days from claiming the package. This action can't be made by the companies that bought the items, only private clients can apply. 4.2 In case of returning the product, customer should send it back within 10 days from claiming it. Costs of delivery are covered by customer. 4.3 Returns are allowed only if the product wasn't used (doesnt have any signs of being used) and is originally packed. Products cannot be returned, if the customer took off wrapping (for example foil covering display) or the protecting seals 4.4 If all conditions of returning the article are fulfilled, repayment will be made immediately. 5. Final provisions 5.1 modernHST reserves the right to: a) change the prices and amount of products during the day b) withdraw products from the offer c) add new products to the offer d) make promotional actions 5.2 In case of wholesale trade, please contact us by email: modernhst@tlen.pl |
